Do you have a legally competent person in charge of your Health and Safety?
As a business you are required to have a competent Health & Safety person to oversee legal requirements relating to Health & Safety, this can be a suitably qualified/competent, employed person or a Safety Consultant, such as myself.
Employers are legally required to ensure that people who have health, safety and welfare responsibilities in the workplace are competent. There is no statutory requirement to be a technically qualified Health and Safety professional, just to have the necessary competence to ensure that the company meets the required regulations, but if something was to go wrong then the level of competence will be questioned. If the level of competence was deemed insufficient, then the Company and Directors would face a heavy fine.
This duty comes from the Management of Health and Safety at Work Regulations 1999 (MHSWR), Regulations 7 and 8. These Regulations require employers to appoint competent persons to assist them in meeting their legal obligations for health, safety and welfare of employees and importantly anyone else who may be affected by the employer’s activities.
The Duties imposed on employers by MHSWR Regulation 7
- Reg 7(1) requires employers to appoint one or more competent persons to assist him in meeting, his legal duties
- Reg 7(2) requires the employer to make arrangements for ensuring adequate co-operation between, the persons so appointed
- Reg 7(3) requires the employer to ensure that the number of persons, the time available to them to, undertake their functions and the means at their disposal are all adequate
- Reg 7(5) says that a person shall be regarded as competent where they have sufficient training and, experience or knowledge and other qualities to enable them to properly assist in undertaking the measures required

I am working with a range of clients on a consultancy basis to ensure that they meet all of their obligations in respect of Health & Safety. I offer this service on a cost effective annual basis for a set fee.
My services consist of three visits to undertake compliance work such as Fire Risk Assessment, Health and Safety Audits, Training for Employees, offering general Health & Safety advice, as required. If additional work is required, this would be agreed prior to completing the work.
